Changes to buying property in your SMSF

The federal government has just announced a prohibition on borrowing to buy residential property in your SMSF, a strategy many of our clients have used for various reasons.

Here is one example: a 45 year old, recently divorced, who didn’t have enough equity outside super, used their superannuation to guarantee themselves housing security in retirement (purchase future home now in super with a loan, rented it out, pay off home loan over next 10 years with contributions) at retirement transfer into own name debt free (pay the stamp duty). This has kept them from being locked out of the property market in future. This kind of solution is now off the table.

However, there are many things you can still do in your SMSF in terms of property:

  • use of unit trust structures;

  • purchase commercial property in your SMSF for your business to operate out of (subject to confirmation of actual legislation but it has not been specified);

  • become an equity partner in a property development;

  • Purchase residential property without debt - solely or as tenants in common.

I do this for my adult kids who have part time jobs whilst studying each year. I deposit $1,000 into their super fund, the government matches it with $500. Small investment, huge compounding. (the maximum applies if their income is less than $47,488).
